1. Acceptance of Terms
By accessing or using CariLearn Excellence Academy (“CariLearn”, “the Platform”), operated by Carib Excellence Academy Ltd, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Platform. If you are under the age of 18, a parent or guardian must accept these Terms on your behalf.
2. Platform Description
CariLearn is an online educational platform that provides structured, syllabus-aligned preparation for Caribbean Secondary Education Certificate (CSEC) examinations. The Platform offers lesson content across 21 subjects, AI-powered grading and feedback on student submissions, progress tracking and performance analytics, and parent-linked reporting. CariLearn is a supplementary educational tool and does not replace formal schooling or official CXC examination services.
3. Account Registration
To use CariLearn, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security and confidentiality of your password
- Accept responsibility for all activity that occurs under your account
- Notify us immediately of any unauthorised use of your account
Students under the age of 16 must have their account created and managed by a parent or guardian. We reserve the right to suspend or terminate accounts that provide false information.
4. Student and Parent Accounts
CariLearn supports linked student and parent accounts. Parents or guardians may link to their child's account to monitor academic progress and receive performance reports. By linking accounts, parents agree to:
- Oversee their child's use of the Platform
- Ensure their child complies with these Terms
- Accept responsibility for any activity on their child's account
5. Acceptable Use
You agree not to engage in any of the following prohibited conduct:
- Cheating — submitting work that is not your own, using external AI tools to generate submissions, or any form of academic dishonesty
- Account sharing — sharing your login credentials with others or using another person's account
- Harassment — abusive, offensive, or threatening behaviour towards other users or CariLearn staff
- Reverse engineering — attempting to decompile, disassemble, or reverse engineer any part of the Platform
- Interfering with or disrupting the Platform's infrastructure or other users' access
- Using the Platform for any purpose other than legitimate educational use
6. Intellectual Property
All content on CariLearn — including but not limited to lesson materials, assessments, rubrics, AI-generated feedback, images, graphics, and software — is the intellectual property of Carib Excellence Academy Ltd and is protected by applicable copyright and intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any CariLearn content without our prior written permission. Your access to the Platform grants you a limited, non-exclusive, non-transferable licence to use the content for personal educational purposes only.
7. AI-Generated Feedback
CariLearn uses artificial intelligence to evaluate student submissions and provide feedback. This feedback is generated by AI models and is intended as educational guidance to help students learn and improve. AI-generated feedback:
- Is not an official CSEC grade or certification
- May occasionally contain errors or inaccuracies
- Should be used as a learning tool, not a definitive academic assessment
- Does not replace the evaluation of qualified educators or CXC examiners
8. Payment and Billing
CariLearn offers subscription-based access to its content and services. By subscribing, you agree to the following:
- Subscription fees are billed in accordance with the plan selected at the time of purchase
- Free trial periods, where offered, are subject to the terms stated at the time of enrolment
- All payments are processed securely through PayPal. CariLearn does not store payment card or bank account details
- Subscriptions renew automatically unless cancelled before the renewal date
- Refund requests are handled on a case-by-case basis in accordance with our refund policy
9. Termination
We reserve the right to suspend or terminate your account, without prior notice, if we reasonably believe you have violated these Terms or engaged in conduct that is harmful to other users or the Platform. Grounds for termination include, but are not limited to, academic dishonesty, harassment, and unauthorised use.
You may close your account at any time by contacting us. Upon termination, your right to access the Platform ceases immediately. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.
10. Limitation of Liability
The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Carib Excellence Academy Ltd disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that using CariLearn will result in any particular examination outcome. Academic success depends on many factors beyond the Platform, including individual effort, classroom instruction, and examination conditions. In no event shall Carib Excellence Academy Ltd be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Saint Lucia. Any disputes arising out of or relating to these Terms or your use of CariLearn shall be subject to the exclusive jurisdiction of the courts of Saint Lucia.
12. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will provide at least 30 days' notice by email or through a prominent notice on the Platform before the changes take effect. Continued use of CariLearn after the effective date of any changes constitutes your acceptance of the revised Terms.
